California’s cap-and-trade system for managing greenhouse gases can go forward, even as a lawsuit threatens to take down the entire program. An appellate court made the ruling in a victory for the California Air Resources Board. The state board is still pursuing an appeal to a judge’s order that alternatives to cap-and-trade be considered, such as a tax on carbon fuel. Environmental justice groups who brought the initial suit believe cap-and-trade will create “hot spots” that will disproportionately harm low-income communities of color.
